Generally, when a probate is filed in the state of death, a statement in the Petition/Application can contain the fact that there is an original Will, that has not been obtained. Once the Executor/Personal Representative is appointed, the court can include an order for the attorney to provide the executor with the original Will or simply subpoena the attorney for the document.
