Wills

questions & answers

Question: My husband and I need to change executors of our will due to health issues of our first choice of executor and due to carelessness of second choice person. Our will was done in Northern Nevada in 2007, we moved to Arizona in December of 2017. We would like to know if we can get help with this issue due to our lo-income and my husband's health. Thank you.

Answer: In Arizona executors are called personal representatives.  You can do a handwritten codicil to your Will if you do not want to go through legal channels.  Arizona Revised Statutes, Sections 14-2502 and 14-2503 are the Arizona statutes governing what makes a Will valid.  You can write out a hand-written document ratifying all the provisions of your Will dated _____(whenever the Will was signed), with the exception of the personal representative.  You can then say you are changing the personal representative, name your new selection, then date and sign the document.  The entire document should be in your handwriting, and it would be best to have it witnessed by 2 witnesses who are not relatives.  Keep the two documents together. The Arizona Will statutes would consider the two documents together to be your Will.
