Question: My husband was fired from Amazon for missing a day for taking our youngest son to the hospital because our son was having a seizure. Does the FMLA cover this?

Answer: The FMLA provides job protected leave for an employee to care for their child who has a serious health condition. Care for the child includes transporting a child to and from a medical service provider for the child to receive medical treatment. The FMLA defines child as a son or daughter under 18 years of age or 18 years of age or older and incapable of self-care because of a mental or physical disability. To be eligible for FMLA an employee must 1. Work for an employer that has fifty or more employee working within a 75 mile radius, 2. Have worked for the company for at least 12 months, and 3. Have Worked 1250 hours in the last twelve months. Employees eligible for FMLA are entitled to 12 weeks of job protected time off in the FMLA year.
