Question: I have filed a charge with the EEOC against my employer. Do I have to find another representative for wrongful termination, breach of contract? I was suspended for 2 weeks to take care of a legal issue but then was termed on the 6th day into the 2 week suspension on matters not relevant to suspension.
Answer: Claims of unlawful discrimination based on an employee's race, religion, national origin, color, sex, age over 40, disability, or genetic information must first be investigated by the EEOC (or Arizona Civil Rights Division). An employee filing a claim with the EEOC does not have to have an attorney. The EEOC does not have the authority to investigate a claim of wrongful termination based on breach of contract. You will need to consult with an employment law attorney about your breach of an employment contract claim.
