Question: I am currently in the Military, expecting to get out in October, and moving from Washington (where I am currently stationed) to my home state (Arizona). Can I file for custody as soon as I am back in Arizona considering I am from there and it is still considered my home? Or do I have to file in Washington where he and I are currently stationed?
Answer: I'm not sure from your question whether you have custody now, if the child resides with you or how long you have been in Washington. This information is necessary to answer your question. You can review the UCJEA information here that might be helpful: http://www.uccjea.net/resources/uccjea-flowcharts-gen.pdf
Also Military One Source has info on child custody in regards to military service: http://www.militaryonesource.mil/legal?content_id=269192
You will find more information on the website regarding divorce and child custody. You may want to speak with an attorney. You can contact us for a free consultation with a Military Assistance Project attorney at 866-637-5341 or go to www.LawforVeterans.org
