Eviction

questions & answers

Question: I have a roommate at my house under month to month contract gave him 30day eviction notice. He is being bitter about it like making noises middle of night. Just making it hard for these last 30days. Is there a way to settle this and possibly have him move out earlier?

Answer: For more specific instruction in your case consult an attorney. During the term of a lease or rental agreement you can only be evicted for cause. If you have a lease the right to occupy terminates when the lease is over and there is no need for notice. If you are "month-to month" there must be notice at least 30 days notice. "Eviction for Cause" could be a lack of quiet enjoyment (the right to occupy your property with the purpose intended without interruption.
