Question: How do i legally force my fiance's mother to move out? She's not on my lease and has been asked to leave since June. She advised that she will not leave and I need to know how to go about this the legal way.
Answer:
If a person is not a legal tenant of the home and they refuse to leave, the person is considered a trespassers. Police may be called in order to get the person out of your home. Unfortunately, even without signing the lease, if the person has been receiving mail or paying for rent in some form, they may be legally considered a tenant and the process can be more difficult. Familiarize yourself with the Arizona Landlord and Tenant laws. You may also consider hiring a licensed attorney who will be able to assist you with the proper course of legal action.
