Question: So i just moved down here about a month ago with to move with a friend my name is not on the lease and i also have mail here and hes trying to kick me out in kess then 24 hours but i have no where ekse to go because i am originally from ohio. What are my rights.

Answer: In these sort of situations, the answer depends on whether or not a rental agreement (whether written or merely oral) exists between the person whose name is on the lease and the person who recently moved into the dwelling. (A rental agreement does not need to take the form of a written lease in order to be legally enforceable, but having some sort of evidence always is helpful. Examples of possible evidence of the existence of a rental agreement include rent or other payments and email correspondence describing a tenancy arrangement.) The answer to the question of whether or not a rental agreement exists determines whether the person whose name is not on the lease is a guest or a tenant. If that person is a guest, then they may be asked to leave at any time. However, if that person is a tenant, and no specific tenancy period was agreed to, then the default is a month-to-month arrangement, which means that they must be provided with 30 days’ advance notice (A.R.S. 33-1375).
