Question: I am being threatened to vacate the apartment by my landlord, but I have not received written notice. The reason I have been told to vacate is because my landlord believe I have an unauthorized tenant but she has no proof that the person lives with me and is not giving me the ten day notice to add them to the lease and this is low income is this right or can I fight this?

Answer: If and when a tenant receives written notice from the landlord alleging that the tenant has an unauthorized person residing in the dwelling and stating that if this alleged violation of the rental agreement is not fixed within 10 days then landlord will terminate the rental agreement and go to court to have the tenant evicted if necessary, the tenant’s only option is to comply with the terms of the rental agreement (A.R.S. 33-1368(A)). The landlord is not obligated to alter the rental agreement to include an additional tenant, so the tenant may wish to attempt to negotiate a mutually satisfactory solution with the landlord.
