Question: I got a ten day notice to pay rent or quit or ten day notice yesterday was last day for that my question is how long do I have until the actual eviction and I'm moving out any way so what do I have to do

Answer: The Arizona Residential Landlord and Tenant Act requires landlords to provide their tenants with a 5-day pay or quit notice when rent is due and unpaid before the landlord may go to court to seek the tenant’s eviction (A.R.S. 33-1368(B)), while the Arizona Mobile Home Parks Residential Landlord and Tenant Act, requires landlords to provide their tenants with a 7-day pay or quit notice when rent is due and unpaid before the landlord may go to court to seek the tenant’s eviction (A.R.S. 33-1476(E)). If a tenant receives such a notice and does not intend to pay the rent, then it is absolutely necessary that the tenant vacate the dwelling (move out and return the keys to the landlord) before the pay-or-quit period concludes – because once the landlord goes to court to file an eviction complaint, the tenant becomes responsible not only for paying all rent and late fees owed but also the landlord’s court costs and reasonable attorneys’ fees. The tenant may also be formally evicted – and have an eviction judgment entered onto their permanent record – even if the tenant has already moved out before the landlord’s complaint is heard in court.
