Question: I was late on October rent and the owners agreed to give me extra time to pay, until they learned I was in a bad car accident last week. Now they are saying to pay by tomorrow or they will proceed with an eviction. I am scared to death. My back is broken. The accident was the other drivers fault and I already have a lawyer working on it. Can I get a protective order to grant me extra time to pay rent?

Answer: Under Arizona law, the only defense to an eviction complaint by a landlord on the basis of non-payment of rent is the payment of rent by the tenant (A.R.S. 33-1368(B)) – unless the tenant can show that the landlord agreed to accept it late. It does not matter why the tenant cannot pay.
