Question: lived in this park for 13 yrs.new managment trying to force everyone in the park with new lease and rules.if you dont sign the new lease,they dont accept your rent check.insane rules like no babysitting in the park,no washing your car(we pay for the water),no pets over 30 lbs,a pet fee and they must approve the pet,which are in my home that i own and dont even go outside.we are only allowed the number of cars that now fit in the carport which is only 18 to 20 ft long,they want to chage a 25 dollar fee for every notice they send out also.the list goes on.is this legal? how does grandfather work

Answer: The mobile home residential landlord/tenant act permits a landlord to adopt rules and regulations "to promote the convenience, safety or welfare of the tenants...preserve the landlord's property from abusive use, preserve or upgrade the quality of the mobile home park or maike a fair distribution of servces and facilities..." A.R.S. 33-1452 A 1. Rules "must be reasonably related to the purpose for which adopted." A.R.S. 33-1452 A 2. Tenants must be informed of rules changes in writing at least 30 days in advance and any rule "which is unfair and deceptive or which does not conform to the requirements of this chapter shall be unenforceable. A.R.S. 33-1452 D. Rules can only be changed during the term of a rental agreement if the do not work a substantial modifacation of the rental agreement. Without knowing the exact changes or the landlords rationale for them it is hard to ascertain whether they are reasonable under the circumstances. You should contact an attorney with expertise in mobile home issues who can advise as to the specific changes.
