Landlord and Tenant - Mobile Home Parks
questions & answers
Question: Can a landlord demand a 60 day notice after a lease has expired and the tenant is on a month to month lease? In the expired lease, it stated a 60 day notice is required. They still demand a 60 day notice after the lease has expired and tenet is only on a month to month.
Answer: As a general rule, when term of a rental agreement expires and neither party terminates the agreement, it automatically continues on a month-to-month basis, and all the original terms and conditions (including any that specifically addressed what would happen if the lease became a month-to-month agreement) continue to apply.
