Question: I have an issue with my home owners association, they have locked me out of the access gate to the pool area that is close to my condo. Now I have to walk a considerable distance to another access to the pool. They have denied me a key, when I previously had a Kay before.

Answer: Homeowner's associations are governed by their Covenants, Codes and Restrictions, commonly referred to as CC&Rs. A homeowner may request a copy of their CC&Rs from their homeowner's association (HOA) or landlord to review the individual rules. For further information review the following Arizona Revised Statutes (ARS) relating to HOA's: 33-2001 Definitions 33-2002 Homeowners' association dwelling actions; conditions 33-2003 Applicability http://www.azleg.gov/ArizonaRevisedStatutes.asp?Title=33 DO NOT POST will be used as a teaching tool then the above will be posted. Request a copy of the Covenants, Conditions, and Restrictions (CC&R's) from the landlord or HOA. Find the regulations relating to community property access for the homeowner/lease holder. Point out that the HOA must act in "good faith" under the law.
