Question: i am in a contract dispute requiring mediation and/or binding arbitration. How do I file? The total amount is $4K. Thank you
Answer:
Many contracts will state that a specific process needs to be followed if there is a problem with a contract. Often that process will be mediation or arbitration.
If mediation is required there are several ways to find a mediator who will serve as a third party to help the two conflicting parties come to their own resolution. Mediators can be found on the internet or phone-book.Once a person finds a mediator and requests a mediation the mediation process may begin.
Arbitration is an agreed on private trial where a third party, the arbitrator, decides the outcome of the dispute and how it will be handled. Arbitration begins when one person submits a demand, or statement of claim, for arbitration to an arbitration organization. Arbitration organizations can also be found on the internet or in a phone-book.
Neither mediation or arbitration begins in a court. For more information about alternative dispute resolution please read the State Bar of Arizona's article on Alternatives to Trial.
