Question: My ex-husband past away and had not taken my name off the escrow loan, he left no will and we have an adult daughter, now the loan company is after me for the payments. If I pay the loan does the house belong to me.
Answer: Arizona is a community property state. Under ARS-211, all property acquired by either husband or wife during the marriage is the community property of the husband and wife. ARS 25-215 states that the debts incurred on community property become community debts that both husband and wife are responsible for.
