Question: I put a down payment down on a car and decided I did not want it before taking possesion of the vehicle . I needed a co-signer , I signed but my co-signer did not . how do I get my downpayment back ?
Answer:
The following information is intended to be a general overview. For detailed legal advice and to understand how the laws apply to a certain situation, seek the advice of an attorney.
In general, when a dealership or other establishment requires a co-signer in order to complete a contract, they will most likely say a contract has not been entered into until both the signer and co-signer have signed the contract. According to ARS 44-286(b), until the seller delivers to the buy a copy of the contract signed by the seller, a buyer who has not received delivery of the motor vehicle shall have the right to rescind his agreement and to receive a refund of all payments made and return of all goods traded in to the seller on account of or in contemplation of the contract, or if the goods cannot be returned, the value thereof, see ARS 44-286(b) . Contacting an attorney may be helpful to resolve certain issues. This link here provides resources for finding an attorney.
