Question: Im requesting police report from yuma county sheriffs in arizona and said no I can't get copy there is ongoing investigation and I have to get ahold of state attorney. why?
Answer: Oftentimes, Police agencies will withhold records of an ongoing investigation if the information could ruin a criminal case, expose informants in some way that puts them at risk, etc. If this cannot be shown by the agency, you have the right to appeal the denial through a special action in the superior court, pursuant to the rules of procedure for special actions against the officer or public body. (ARS 39-121.02)
