Question: if i have not been served as a witness but told on a phone call do i legally have to appear?

Answer: If you have been designated as a witness in a court proceeding (meaning you are not a party to the action) and  (1) you have not been served with a subpoena to appear in court  and (2) you have not signed a document accepting service of a such a subpoena, then you are not legally obligated to appear.
