Question: Can a person file a order of protection on a live in caregiver and we believe they did this to put the lady I care for in a nursing she is so stressed out over this its causing alot of problems witb her health what can we do to stop this

Answer: Orders of protection may be filed when a relationship exists between the abuser and the abused. A live-in caregiver would qualify under Arizona statute, “the relationship between the victim and the defendant is one of… persons residing or having resided in the same household” (ARS § 13-3601). When a person is served an order of protection, they are called the defendant. If they disagree with an order of protection, it can be contested. The defendant has a right to request a hearing that will be held 5 to 10 days after the written request is filed.
