Question: Can a arizona bank refuse a power of attorney to cash my boyfriends paycheck if he is in prison?
Answer: A bank may generally not refuse an individual’s durable power of attorney to cash their principal’s pay check. However, the bank may have certain protocol they follow to prevent fraud. For example, the bank may require you to endorse the check by signing the back of the check "his name by your name, as his agent" or "his attorney in fact." The bank may also request that you bring in the documents naming you as your boyfriend’s power of attorney.
