Dealing with Debt

questions & answers

Question: My sole income is Social Security. I just received a civil summons from my old credit union for my credit card debit. Can they garnish my Social Security income? My Social Security is direct deposited into my bank account. I CAN NOT afford an attorney, just wanted to know my rights.

Answer: It is not possible to answer a question like yours over the internet. The issue is complicated. Generally U.S. Department of Treasury Rules preclude creditors like a credit card company from garnishing some Social Security Benefits. Your best bet is to speak with a lawyer. Call The Senior Citizens Law Project to see if they can help. The telephone number is (602) 252-6710.
