Question: I am a retired soldier my former spouse has remarried.. Do I have to continue former spouse payment?
Answer: Check your divorce decree. Most contain language that terminates spousal support when the receiving spouse remarries. If the decree requires you to continue support (unlikely), you have the right to file a petition with the court requesting that the support be terminated because there has been a significant change in circumstances. I am assuming you are an Arizona resident and that your decree was in Arizona. If so, you can go on the court's website and get forms and instructions in the family law section of the self-service center. Go to: https://www.azcourts.gov/familylaw. If you are not living in Arizona and your divorce decree is from another state, check with legal services agencies in your state of residence.
