Losing Spouse/Parent

questions & answers

Question: My wife passed away almost 3 years ago. She had a will drawn up while we lived in Las Vegas, Nevada. Is this will valid in Arizona?

Answer:

Arizona Revised Statutes (A.R.S.) Section 14-2506 discusses situations in which written wills are valid. One situation is if the will's "execution complies with the law at the time of execution of the place where the will is executed." http://azleg.gov/FormatDocument.asp?inDoc=/ars/14/02502.htm&Title=14&DocType=ARS).

A.R.S. Section 14-3108 discusses the amount of time allowed to pass before the process of probating a will (proving in court that the will is valid) must begin. This depends on the type of proceedings you choose to pursue and may be reviewed at: http://azleg.gov/FormatDocument.asp?inDoc=/ars/14/03108.htm&Title=14&DocType=ARS.
