  • Our apartment has a black mold problem because of a slow leak in the wall. When out landlords insurance adjustor came to see the damage he informed us that the landlord was required to test the mold to find out if it was toxic. When we asked our landlord about testing he said he didn't have to test it just clean it up. Which is true? We would like them to test it so we know what we have been living in.

We are afraid that once we tell the landlord he will evict us. What are our rights?   • I'm looking for some guidance regarding the AZ Real Estate Recovery Fund. I submitted a claim against the fund some time ago but it was denied for multiple reasons, all of which were inaccurate. I'd like some advice from somebody with experience with getting reimbursement from the fund. The basis of my claim is the fact that my property manager embezzled security deposits and when his scam ran its course, he committed suicide. The fund is clearly setup to help those who have been a victim of real estate fraud, but the commissioner weaseled her way out of my claim on technicalities.
  • Hi, I am trying to get my security deposit back after two months since moving out, and I am preparing for a small claims court case. My question is: Can I use text messages in the small claims court case to provide documentation of what the other party said to me and to also help establish a timeline of events? If so, how should I go about doing this (bring the phone, print out the text messages from my phone, etc.)? Thanks!
  • I assigned a 30 day reservation to rent a unit from a person who later was discovered is not the owner or the tenant on the lease. When I contacted the owner and the management the 30 day reservation is against the rules of the facility. We also received made up fines from the person lying that they were generated from the homeowners association when I spoke to the homeowners association there was no such fine ever levied how much is the satiation call the police and has a police report from this particular person being fraudulent. Where do we go for help to get our deposit back. Is this person even our landlord
