Question: If my friend is my beneficiary on my bank account,and he owes back child support can my account be garnished? and he does not have access to my account
Answer:
When the State garnishes money for back child support, it looks at the money that is currently owned by that person in their own accounts, or that can be earned, like through a job. A person who is a beneficiary on a bank account does not currently own the money in that account, it is owned by the person who's name appears on the account. Like a will, a beneficiary will not gain access to the money in the bank account until the current owner dies. So the State should not be able to garnish a bank account because the beneficiary on the account owes back child support.
