QUESTIONS

  • If you have a lease, and you have had non stop roof leaks from the rain storms. Black mold growing in the ceiling. Constant requests to get them fixed have not stopped the leaking. Landlord says the lease can be broke after Dec. can he keep my deposit if we decide to take our baby and move out early?
  • Is the landlord obligated to provide pesticide treatment if the tenant reports that he found a few roaches. The pesticide treatment on the lease was left blank. The other items were checked on the lease.
  • In my divorce the Judge issued a Final Ruling months ago, but it seems there is no way to get a Final Decree. My ex keeps requesting delays claiming medical issues, but has provided no proof to the court of any medical issues. In the meantime I keep paying more and more temporary spousal maintenance and attorney fees. The Judge keeps approving my exs requests for more time. My attorney has filed a Final Decree with the Judge. How long can the Judge take to sign a Final Decree (months or years)? What else could my attorny do to push along my case? No one but me wants the divorce to be done

  • I have two boys ages 8 and 11 they are with me 50% of the time and my ex wife their mother the other 50 5 of the time. this was established in the divorce papers. Their mother has a new job theat requires her to work 12 hour night shifts. I have offered to take the boys duing these times and was denied by their mother. I have since requested the names and contact info of the individuals who will be watching them during these times and was denied this information by the mother as well. My question is- What are my rights and what can I do to insure that my boys are properly cared for?
  • My vehicle was recently repossessed. The towing company won't allow me obtain my personal property left in the vehicle until I pay the accrued "storage fee" that increases $20 daily. Is this legal? Can I charge them for the car keys that they want me to turn over?

  • My son-in-law sued for divorce from my daughter. Two kids are involved--16 and 11. His attorney (say Mr. X) has subpoenaed me to testify on his client's behalf. I do not want to testify. Q1. Does the fact that his attorney met with my wife and me c. 1 yr ago to discuss my daughter's issues as the relate to the kids disqualify him as having knowledge we gave in confidence to him? Q2. Does the same apply to my wife, my daughter's step mother? Q3. I have worked with both to provide a negotiated settlement, divulging information that may compromise her if I testify. Will this disqualify me?
  • Can a landlord that has no lease with the tenant file eviction for non payment of rent? Landlord does not maintain the property. It is a mobile home. There are safety issues that have not been addressed. There has been no communication from the landlord to the tenant.
  • I had a friend staying with me to help pay the rent. They left (without paying debt) and left several of their things at my house. I want the things out. How long do I have to store their belongings until I can get rid of them. I have informed them several times and they will not collect their things.
