QUESTIONS

  • My family and I have a lease for property. Today we received a notice taped to our door stating that there was going to be a "notice of trustee's sale" on the property. What rights do we have in this situation? Is this considered our 30 day notice to vacate? What action or responsibility does the management company have in this situation?
  • I filled divorce last March 2010 and it was dismissed on April 30,2010 then I reinstate last May 2010? When will be the divorce final, from now I did not recieved any answer from the court?

  • I live in an HOA where the board wants to change the CC&Rs to start requiring homeowners to provide deposits for several things, such as bringing in dumpsters. I reviewed Title 33 and the only place where I see they can require a deposit is for remodeling a main house (33-1817.B) in order to make sure the remodel complies with approved plans. ARS Title 33 is clear that the HOA can assess fines and assessments but, other than this one instance, it does not say they can require deposit. Are they allowed to do this?
  • I am being sued/summoned from Chase through a debt collector to appear in court, they came to my home and made my 16 year old daughter sign the document, This is a 6 year old debt (they sent this account in January 1st 2008 to collection) and after this date I didn't receive any collection letters.
