QUESTIONS

  • Under the Uniform Services Former Spouses Protection Act, the 2017 Rule. If my former wife and I made a verbal agreement to split retirement pay 50/50, will DFAS honor that or would they need a court document stating the amount she would receive?

  • I signed a contract in mid april to have my kitchen remodeled. I gave the contractor a down payment for the future job. They had their license suspended two days later and can not do any work until it is renewed. Now the company has changed names and license numbers. Is my contract with them void? Can I get my down payment back. No work has been done. The company will not return my calls. Should I file in small claims court?
  • We decided to withhold rent to force the landlord to repair some unhealthy living conditions. We verbally told the manager that this was why the rent was withheld. They finally got the repairs completed and agreed to a $500.00 discount for the month. They are trying to charge late fees for the month that the rent was withheld. We don't want to move but we don't think it's fair to have to pay late fees considering they agreed their fault for dragging their feet on repairs.
  • My senior friend cannot pay her credit card debts (her son ran them up and then abandoned her). Her only income is Social Security and her home was inheirited (already paid off when it was inheirited). She cannot afford to file bankruptcy. She quit paying her debts over a year ago- sent them a letter stating that she cannot pay, fixed income etc. One of of the creditors recently sent a letter regarding arbitration. If she does not respond it means she agrees to their terms. I suggested to her that she respond by sending the original letter. Is there a better way to respond? Also, is her home safe from a judgement? I know her income is. I thought I read her home could not be taken. If true, would it require a lengthy court battle?
  • after having locks changed how many days do i have to get my belongings out of apartment

  • In a child custody case, I lost my children to my ex. My children & I suffered alot of abuse at his hands. Now he has the children & lives in another city & jurisdiction in Arizona. The info and dr. reports I took in were not even looked at by the judge. Seemed her mind was made up early on. Can I request a new emergency hearing and also request a change in judge as I am told the abuse on the children has started again and I don't know what to do to protect my children.
