  • My mother recently passed away with no will and no power of attorney. She had a checking account that has me as a signatory. It was all her money and I've paid her funeral expenses, etc. from it. Can I use the money that is left for my own purposes?
  • I got granted temporary sole legal decision making of my daughter but during this case I got into a car accident with my other daughter, I was not the driver or passenger and had no illegal part in this accident. Now my daughters father is telling me he has temporary sole custody and I cannot see her at all. He has domestic violence and was told that sole custody was not an option in our case for him. He got a lawyer and we made a settlement so it would be easier for me because the accident ruined everything with my life and I signed it but she told us that we needed to get it notarized.
  • If I believe my tenants have skipped and they are not claiming certifiied mail which is sent to them at the property address, may we enter the property after posting to the front of the residence the 48Hr Notice to Enter and Inspect? This notice was mailed first class and Certified mail return receipt along with being posted . This action was outlined in the tenants Residental Lease Agreement for us to have the right to inspect after giving notice. Are we safe to enter?
  • I rented a home for almost 8 years. We were never offered any carpet cleaning or paint the entire time we were there. The landlord about a year ago said they would give us paint but only with a new year lease. I heard that they are required to offer carpet cleaning and paint every 2-3 years. They are trying to charge us now that we've moved for carpet cleaning and new paint. Are they able to do that when we got nothing the whole time?
  • I made a huge mistake by cosigning on a car loan for a girlfriend back on 09/15/08. She only made 9 payments on the vehicle then let it go back to the bank. It’s been almost 6-1/2 years since she made her last payment and now they’re coming after me, after all these years have gone by. I was told that Arizona Statute of Limitations A.R.S. § 47-2725 is four (4) years for auto loans. But their attorney is ignoring that and coming after me regardless. It's now October 2015 and they are coming after me for the loan amount + interest totaling $13,000 altogether. I'm retired and living solely on Social Security of $1,776 per month and two small pensions totaling $624 which = $2,400 per month. And I'm living with my daughter to make ends meet. Therefore I can't afford to pay theses people. I had an initial pre-trial conference on 10/8/15 and represented myself because I can’t afford an attorney. It was determined that there will be a trial on 12/14/15. I told the loan company in court “that I have no money and living on $2,400 per month and living with my daughter to make ends meet, and they’re still pursuing the trial date. My questions are: 1) Will the Arizona Statute of Limitations A.R.S. § 47-2725 four (4) years get me out of this mess completely? 2) I've been told and read online that Social Security income and Pensions “cannot be garnished”. Do you know if this is true? If it's true then I have nothing to worry about and won't need to file bankruptcy. 3) If I lose my case can I file bankruptcy on a judgement that's been awarded against me? 4) Can they levy / garnish my checking account where my Social Security checks and Pension checks are electronically deposited?   • Moved into renovated home was to be done by 6/18 (day moved in). Upon arrival; 2 baseball size holes in 2 windows & piles of trash under carport. Due to incorrect measurements windows would be another week. Week1 dryer vent had to be re-cut, electrician rewired house due to fire hazard. Week2 plumbing unable to do laundry 2weeks now, family has to share 1 bathroom, windows not replaced. Week3 windows replaced 7/1–7/6, plumbing on hold to find better price (laundry?), & still sharing bathroom. Was given 1 months free rent but asking us to pay full electricity bill. What are her obligations?
  • An insurance company contacted us and informed us that our father purchased us whole life policies the year of our birth. He is not alive so we have no information on these policies. The insurance company claims that both my brother's and my policies have had two loans issued against them on the same date. They cannot provide us any documents to prove the loans that have over the last 30+ years have increased for interest and penalties to over $8500 on each policy. It is my understanding that an active contract requires documents associated must be kept. Would that be accurate?

  • my child is 3. ex has never provided child support or medical help. even after being ordered to do so 12/09. ex is on/off drugs. rarely showed up to visitations. child and i have had orders of protections (expired 5/2011) against him for violence towards myself in past. many other acts of violence were made on his part, regrettably i never reported them. he is being investigated by cps involving another child who has been hurt. but no charges against him yet. it is an ongoing investigation. i fear dearly for my child's and my own safety. what are my chances of getting his rights removed?
