  • I don't know if you can help us or maybe direct us to someone who can. KayKay Properties took over as managers of our apartment building. This is not an assisted living facility, but regular low income senior apartments. I am one of the original tenant and the other original tenants and we have gone through several managers. But this company has come in and is trying to dictate to us, change rules that make so sense and threaten with evictions. We have been told that none of our grandchildren under the age of 18 can spend the night with us anymore, if they do, we will be evicted. If someone is on medical marijuana they can't smoke it in their apartment, they have to leave the building and smoke in the parking lot. If they smoke in the building they will be evicted. We can't go to check out mail in our robes, if we do we will be evicted. They will spray for roaches, but we have to count the number of dead ones, and if they have to spray again we have to pay for it. If we don't pay for the exterminator, we will be evicted. If any of us are ill and need family or friends to help us, we have to let management know who they are, where they work and how much they make, if not...you guessed it, we will be evicted.   • I live in an apartment complex. On July 26th, 2014, there was a storm and a tree planted on the premises fell onto my car. The apartment complex removed it two days later. They claim it was an "act of God", and won't cover the repairs for the damages to my vehicle. My question is this: Would this fall under the provisions in the Arizona Residential Landlord and Tenant Act, section 33-1324, Landlord to maintain fit premises?

  • The father of my child left the relationship when i was three months pregnant. And he now lives in Missouri. I've recently been told by a friend that if custody is with both parents part-time that the father needs to live within 100 miles of the child. Otherwise his rights can be taken. Is this true?
  • i have a 5 month old. the father has isnt on the birth certificate, hasnt filed for rights or establishment of paternity through the courts or anything. he rarely sees the child and when he does its only when its convenient for him. and 98% of the time, he doesnt even claim the child as his own. for example: he tells me to have the real father pay for things. i do not know his current address and was curious about something. i am currently in a relationship with someone new. if i were to marry this person, could he legally adopt the my child? what would he have to do to legally adopt my child?
  • Our lease has no provision in regarding pest control and landlord being able to charge for pest control services if infestation is found. Our landlord is trying to do this to residents who are mostly SMI or disabled who only means is a monthly check and being on sec 8 or home inc. They don't understand they have rights and are afraid of being evicted as this is what they've been told. I know Residents whohave requested pest service and not received due to not being put on list for service and apts that have bug problems or infestations are being rented then tenants blamed for. What can we do
  • The property owner wants to charge me HOA fees for grounds maintenance. I am a tenant in an apartment complex. When questioned, they said they could do this according to Arizona General Provisions 33-1314 and 33-1314.01. I think this addresses utilities, water and separate meters, not HOA dues. I also will not have access to CC&R's, or be able to have a seat on the board or see the financials, because (in their words) I am not an owner. Can you let me know if they can in fact charge me HOA dues?
