QUESTIONS

  • I understand that when a divorce occurs, everything accumulated is community property. However, is a disability retirement subject to joint disbursement. My online research gives me conflicting answers. How do the courts interpret this?
  • My son passed away June 17, 2016, he was 32 years old. He had never married and had no children. His only asset is a checking account at our local credit union. He had no co owner on the account and did not set up a beneficary. We believe there is under $2000 in the account and would like to close it out and just donate the funds. Since he had no Will and we do not have the money to open probate, is there any other option for us?
  • The mother of my 3 year old child was killed in a car accident recently. Paternity was established at the hospital when my child was born . Up until her death we worked out custody, child support and parenting time without having to go through the courts. She had unofficial "custody", because my child was with her when she died, CPS investigated and informs me that since it appears that mother was the custodial parent, that I need to establish custody through the courts. Can someone make sense of why I would need to establish custody, per CPS

  • we are currently listed as owner's to a mortgage but signed transfer of property- deed papers to an investor of whom we have been making monthly payments to. We have been informed by the mortgage that our payments have not been submitted and that we will soon be in foreclosure. What can we do? This investor promised to assume the mortage as well as the property but really only filed tranfer of property and continues to collect our money, of which has been steady each month.
  • My landlord has given my work email and work phone number out to realtors so that they are contacting me not the landlord for showings of the house., on my work contact. The realtors are also asking for same day appointments etc because they do not realize that I am the tenant not the owner/landlord. Is this a violation of my privacy? I do not want these people to call me constantly at work. I didn’t even want them to know where I work, my schedule etc. I have kids at home when I’m at work and now I have to worry that the landlord is trying to come in when they are home alone even though he’s
  • My packages go straight to the office at my apartments everyone's does. Why do they have to take pictures of my packages big or tiny before they let me have them. And then I have to sign for them. They are not the post office. I don't want pictures taken.
  • We are senior citizens. A bank is offering us a home loan that we assumed was fixed interest-the rate dropped a fraction, even-then I happened to notice an unfamiliar phrase with a tiny checked box-'demand feature'. I looked it up: the bank can demand payment, calling the loan, at any time without giving a reason. It said that some states prohibit that practice. Is Arizona one? Calling the loan could destroy us and force the property into foreclosure.
