QUESTIONS

  • Is it legal for the manager of the property to ask for cash instead of money orders or checks?
  • Can I install grab bars, lower my countertops or make other needed modifications against my landlord’s objections?
  • I am on a month to month lease. On December 4th I gave notice to landlord that my last day in the property will be January 5th. They are stating I am violating the law and that my 30 day notice is not valid as I would have had to give it to then November 30th for December 31st move out date. Is this true?

  • Regarding Bankruptcy: How long does it take to file, can you see a lawyer one day and file the next? Do your credit cards need to be delinquent to file BK or can they be current? Can they take my 401K if I file BK? How long will BK put off a Trustee sale? If your mortgage is delinquent can you still file BK to try to put off the trustee sale? If you have 2 accounts with one credit company like Discover and one is joint with someone else and one is only in your name, can you just file BK on the one in your name only without them going after the other card with joint owner?   • A California court awarded me full legal and physical custody of my daughter after her father hit her. He has been convicted of domestic violence, drug and misc criminal charges. He is supposedly "clean" now and court ordered that he can call my daughter once per week. This is the extent of their relationship. I currently live in Arizona and want to be sure that if something were to happen to me, my sister would have guardianship. My daughter is now 13, does not want to live with him and I strongly believe it is not in her best interest to live with him. She has very close relationship with my sister and my sister would provide stability. Can I "transfer" my custodial rights to my sister and direct that custody not go to my ex or his family in a will?
  • I got a harassment injunction against someone in February 2018, they violated it and are being prosecuted today Oct 2018. They were threatening before, but now they are extremely angry. I am trying to break my lease becasue I dont feel safe with this person knowing where I live and my apt landlord says my injunction/ PO is too old and because it wasn't domestic violence, it doesn't count. This person has threatened me and is obviously being punished by law, what can I do? What AZ statutes if any allow me to break my lease due to my situation?
