QUESTIONS

  • I was given exclusive use of our residence in my OOP. Is my husband still required to pay his half of the rent even though he was required to leave the residence?
  • My husband is in prison for one year for hurting me. I also have a 5 year restraining order against him. Will I be able to get a divorce from him when he is in jail and has a RO.
  • Is it possible to remove a domestic violence charge from my record to stop having a delay when I purchase firearms?
  • I was arrested and charged with aggravated assault with a deadly weapon and disorderly conduct over a year ago. At the time I was threatened by the size of the male standing over and blocking me although he did not verbally say he was going to hurt me. I have a settlement conference soon and my lawyer has said that a plea will necessarily include at least a year of jail time and I would not get off for self-defense if this goes to trial since he did not verbally threaten me. I am pregnant and due to deliver before the settlement conference. Does this plea offer seem reasonable?
  • I was charged for burglary and theft felonies. I signed a plea admitting to the theft and the burglary charge was dismissed. After completing my probation the theft was reduced to a misdemeanor. I then had the misdemeanor set aside. Both the burglary and theft are showing up on an apartment background check and they don't say anything about being dismissed or set aside. Could this be an error? Could the court have mistakenly not cleared the conviction? Or is it the program they are using is not accurate? Thanks

  • In 2011 I was late with my rent payment. I received a notice to pay or vacate. I immediately paid the rent past due and late fees in full. The following month my lease expired, I paid my rent due and moved out. Fast forward to 2013 I find out the apartment filed a forcible/special detainer. Is this legal? Am I able to dispute the judgement? Please help. Thanks
