Question: MCan my sons father, who live in Colorado, take our son away from me? What are his legal rights to our son? We are not and never were married and he is on the birth certificate.

As long as there is no court order giving custody to the father, see this question's answer for help. If there is a court order giving visitation (or as it’s known now, “parenting time”) to the father, it should explain how he can exercise his rights.
