Question: We turned in the emergency form ARS 33-1361 for our landlord to repair leaks and mold that is growing from these leaks. Once the 5 days are up and no repairs have been made, what are the steps to take afterwards?
After the 5 days have passed and the landlord has not responded to your request A.R.S. § 33-1361 allows for the tenant to terminate the lease.
"If there is a noncompliance by the landlord with § 33-1324 materially affecting health and safety, the tenant may deliver a written notice to the landlord specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than five days after receipt of the notice if the breach is not remedied in five days." A.R.S. § 33-1361
