Question: How long can the judge hold a person for being incompetent? No pend charges as a supreme court clear all cases

Answer: The answer to this question can depend on the court and the individual case. The following is provided for informational purposes only.  If you have questions about a specific situation, please click here for help in finding an attorney.  If the court has ordered somebody be placed under the mental care services of the state, the state can only hold the person for the time ordered by the court, unless the court petitions for more time or if the person voluntarily remains. This may mean that somebody may be commited up to an indefinite period if "just cause" is found to exist.  However, much of this will depend on reports from doctors and other factors relevant to the case.  Many of the relevant laws can be found in the Arizona Revised Statutes Title 36, Chapter 5.
