Question: I'm Crystaland my question is what can be done when a landlord doesn't keep the pool & pool area the only time my landlord has the pool area maintained is when people come in from out of town and use her apartments as a winter home. Answer: Under A.R.S. §33-1310 premises includes the grounds and areas outlined in the rental agreement. In Arizona a landlord has a duty to maintain the premises fit. Under A.R.S. §33-1324(2)(3) the landlord shall make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition and keep all common areas of the premises in a clean and safe condition. Now if the landlord is not complying, under A.R.S. §33-1361 the tenant may deliver a notice to the landlord specifying the acts and omissions constituting the breach and that the rental agreement will terminate in ten days after notice has been provided if the breach is not resolved within ten days. If the breach materially affects health and safety then the tenant may deliver a written notice to the landlord specifying the acts and omissions constituting the breach and that the rental agreement will terminate in five days after notice is given if the breach is not resolved within five days. If the landlord resolves the problem within the time frame then the rental agreement shall not terminate. (A.R.S. §33-1361(A)(1)). A tenant should not feel afraid to submit a notice to the landlord advising of the problems with the premises because under A.R.S. §33-1381 a landlord may not retaliate.
