QUESTIONS

  • How do we change the guardianship of my mentally disabled bother from my mother who is now ill herself, to another family member? Also is it possible to have more than one guardian? This would help to prevent this situation in the future if it was possible.
  • Under what legal authority does the father (never married) of my 6 year old, who has been deemed unsuitable for joint custody & has yet been able to abide by basic court appointed supervised visitation guidelines, have to continually bring me to court with neglectful parenting allegations, which are always dropped &, coincidentally, decided that he is the perpetrator in each case? Furthermore, as victim to his court declared domestic abuse (physical/metal), how is it that I am being required to be in contact with the perpetrating father, or at risk of losing my son due to parental alienation?
  • My debts, including my first and second mortgages were discharged in Ch. 7 bankruptcy in 2011. After BK, I contacted my landlord (BBVA Compass), to see if they would agree I stay in my house in exchange for reduced payments. They said OK, but said they couldn't provide me with any receipt or written communication of any kind. However, they are considering the second mortgage in the total owed, despite that debts like these are considered UNSECURED. Should I accept this agreement where I won't have a paper trail to rely on in case of a dispute later? Thanks!
  • Per my lease agreement I sent notice to my landlord that I wanted to renew the lease a month prior to lease ending via email 6/28/19, the same day he sent me notice of rent increase which was received on 6/29/19. He recently replied that we are on a month to month, our lease does not end until July 31st at 5pm. He took over two weeks to respond to email, I am unable to give him 30days notice as he took too long to respond, I recently emailed back accepting he rental amount if a lease is written. What right do I have? Last year when he raised the rent he back dated the 30 day notice.
  • My husband took money out of his gross wages. It is now in his IRA. Our CPA said that it is still partially mine, because he earned the money while we were married. Is my CPA correct?
