QUESTIONS

  • If I have a felony warrant from California. If I get pulled over will my warrant come up when they run my drivers license
  • I moved into a new upstairs apartment unit in May 2011. It is now June 2011. Everything is great, except I have downstairs neighbors who play loud music from 1 am-5 am. The music is soft enough, but the bass is extremely loud. It vibrates our beds, floors and walls. We have spoken with the manager, who says that she can do nothing. The police have come, (twice), and are sympathetic but because it seems to affect only me (the vibration is in the bedroom below me), they don't know what else to do. Can I break my lease? More specifically, I want to change units. Can that be done?
  • My husband was recently arrested for sexually abusing my daughters. He is currently in jail awaiting trial for 3 class 6 felony charges. Of course I want a divorce, but I want to make sure that I proceed in a way that will most benefit my five children. I want to protect them from their father (get sole custody), and I want to do what will help us most financially. So is it best to file divorce papers immediately or to wait until he is convicted? If he is convicted does all of his property revert to me if we are still married? I am thinking long term, I know that I won't be receiving any child support so if the property doesn't revert to me on his conviction, is it likely that courts will give me all the community property in lieu of child support? Thank you.
  • I have a roommate that is threatening to sue me. If he does, what can I do to protect myself as I am already having financial difficulties?
  • Is it possible to have a restraining order or protection order without divulging my home address or place of work. I am getting death threats regarding an my girlfriend's ex who has a history of domestic violence. If he knows this information and knows our whereabouts he will take action against it and has no care in the world for the reprocussion of the law including his own life.
  • I own the house and live out of state and my mother is going to court to do the eviction. Is there a form I need to give her that gives her the ok to be there in my place?
  • Last night I rented a room at the Friendship Inn and paid for 4 nights. The room was filthy. In the middle of the night I saw every species of insect know to man walking around. I have checked out, but they refused to give me back the rest of the money for the unused nights. What can I do?
  • My friend and I was pulled out of the store .possible stolen vehicle.report was called in from border patrol, the Sheriffs department was called in for back and I was arrested for findings from the search. The truck wasn't stolen and our word against them in regards to the giving permission . My question is the responsibility of probable cause by transfer of authority does that diminish when the Border Patrol reported the stolen vehicle does that give probable cause to the sheriff by proxy there should be some case law the states if there was no probable cause by the Border Patrol
  • We are being evicted, our landlord served us three papers, each of which stated a different reason for eviction, loudness, smoking, non-payment of rent etc. Do her statements have to be consistent with one another? If so, can I use her inconsistency as a defence in court?
  • My son past away, I've cared for my grandaughter who is 18months for the past 8 mths. The living parent does not want to allow me time with my grandaughter, do I have rights?
