Is there such thing as a modified restraining order that stipulates the defendant may not come to my place of residence during certain hours? I don't want the defendant to not be able to have ANY contact with me, I just don't want him on the premises during certain hours becuz he is disruptive while I am trying to conduct my home business.

I have been served papers from an Atty's office that I've never heard off, from a Company they're representing, that again I've never heard of stating that I had a Visa card from US Bank, and again I've never have had one, and also they used my nickname, which I would never open a credit card with that name, now, they're suing me for 2,800 and Im not sure where to go from here...I can't afford much for an attorney.

I have recently reviewed our finances and determined that we can no longer afford our home. We are not late and have not missed any payments. I have come in contact with a law office based in CA that offers loan modification, short sale, and deed in lieu services. If we opt to pay someone to negotiate for a loan modification with our lender am I less likely to fall victim to scam with a law office?

Currently paying a ridiculous amount of rent (~$1500 after utilities) for a an apartment home whose complex offers a community Pool as one of the amenities in the Lease. Recently, the Corporate office locked down all amenities completely despite the upcoming heat of the summer. It’s been 95+ degrees outside, and they refuse to open the pool even for a LIMITED pool hour for kids and seniors— is this legal? Does it break the lease? Can I withhold about $200 in rent since all amenities have been locked? Thanks in advance -concerned mama

I have a 7 year old sister from my father and his ex-wife has custody. she hasn't let me even talk to her in about 3 1/2 years, except when I was with my father, but i don't live with my father and I was curious if i could file something in the courts to compel her to at least let me talk to her on the phone?

As a 67 yr. old retiree with an income of 11,645 yearly from S.S. and a small retirement pension, are these monies subject to credit card debt collection? Other than two older vehicles, I have no assets.

I was served my notices and went to court with my landlord. She got a judgement against me for unpaid rent and was granted a writ of restitution to be received on 9-1-09. On the morning of 9-1-09 when I returned to the property to finish moving, she had locked the gates. My dogs were still there and I had not been served the writ by the constable. Turns out that she did not received the writ until 10:18 that morning but the gates were locked at 8:48 a.m. Does the writ have to be served or is it just given to the landlord and they can do as they please?
