QUESTIONS

  • Concerning a Short Sale of Real Property; There are 3 liens. The 3rd lien is a voluntary one for the purchase of a home water purification system. In order to sell the property short, the Bank requires that the 3rd lien agree to be released. The lien holder is unreasonable. They ask for the original $4400 + Back Payments, Interest and Penalties which make the release amount about $10,000. Nothing less is acceptable. The Bank may allow 1 or 2 thousand dollars, no more. Can the 3rd lien be eliminated by an administrative action or through bankruptcy?
  • Our son who was 41 committed suicide. he did not leave a will. I need to have power of attorney so I can deal with his estate. Do we have to file something with the probate court? If so how do I go about that?
  • July of this year my ex-husband passed away and I am executor of his will. I have got a estimate of his mobile home and property. I am the one who is to receive any of his property. My question is do I have to put the property and mobile home in my name as I do not intend to keep it. It is completely paid for. The reason I ask this question is that I am on disability and have no intention to live there due to my health because the place is about 5 miles out in the country. If I put it in my name will it have effect on the benefits I get from disability and the state. Please let me know as soon as someone gets to answer this.
  • I currently have joint custody of my children in which I have them 50% of the time. My ex-wife and I do not agree on which schools our children should attend, and our paperwork states that neither of us can make the final decision. An attorney had told me that if we have tried mediation with conciliation services (which we have tried), then the next step would be to file a motion for school determination. My question is: how do you go about doing that? I do not see forms that seem to pertain to this. Thanks!

Two incidents have been recorded...the twins broke the lock on the back door and ran out of the apt, were picked up by a neighbor 5 mintues later and taken to the apt complex office - #2 was a call made stating that the children were unattended to for over an hour outside (which is not true) - advice on how to handle the court date?
  • I had a DUI in 2005. I thought everything was done. In 2014 the court issued a warrant for my arrest ( I found out because they suspended my concealed weapons license ) .I called the city court and they said it was over a DUI in 2005. I went to court , and the judge said I did not do 36 hours of alcohol treatment. I had receipts for traffic school, MADD school, level 1 school . The attorney I had, when I called him, said that a retired judge was going back thru all the DUI cases because Tucson was broke and was trying to get more money from everybody. Is this legal after 9 years?
