Eviction
questions & answers
Question: My friend has to go to court on a vacation. And he decided to settle and move out by the 10 Dec but I moved in and I can't get out that soon do I have any rights what can I do
Answer: If you are not on lease you are not entitled to occupy the residence. If the landlord knows you are there you could argue that you are a "tenant at sufferance" entitled to get written notice demanding you leave followed by a formal eviction proceeding (See ARS 12-1173 A). However it is also possible that you might be considered a trespasser and subject to criminal citation. Your best bet would be to try to make arrangements with the landlord to allow you time to move out.
