Eviction
questions & answers
Question: I am a 28 year old disabled man with a service dog and I live with 3 roommates whom I do not get along with. One of them (my ex) has threatened to kick me to the streets even though I have done nothing to warrant this. Can my roommates kick me out if I am on the lease? I pay my fair share of the rent, I have not done anything illegal, I have not done anything against my roommates to warrant being kicked out, and I have not broken any of the rules to be a tenant at the apartment complex I currently live in. What are my legal rights?
Answer: Unless there is a breach of the contract between you and the landlord, you have legal rights to continue living in the unit. The eviction notice would have to come from the landlord, not the current roommates. If there are any underlying circumstances, please consult a licensed attorney. Also, contact the Modest Means Project to see if you are eligible to receive aid in the form of reduced fee consultations. The phone number is: 866-637-5341 and calls are taken from 10 a.m. - 12 p.m. and 1 p.m. - 3 p.m. Monday through Friday.
