Question: My boyfriend has lived at our current home for ovet6 years and I moved in July 2013.. the owner also resides at residence. We have a lease that was done last yr thru the end f this year . We unfortunately were left in the dark about the owners financial problems and his home went into bank foreclose, auction and sold approximately a WK ago. We found this out when two men, new owners, approach us last WK in front of the house handing out friend... Now firmer owner..5day eviction notice with his name on it. We spoke briefly to them explaining we have not been given anything. They're throwing us
Answer: Under Arizona law, as a general rule, a tenant in a foreclosed home may be evicted with 5 days’ notice. You may wish to speak with an attorney about your specific situation as soon as possible. There are links to organizations offering free or low-cost legal services on this website. You should also be aware that under the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 10), if the owner of a dwelling that is already subject to a foreclosure action wishes to rent that dwelling to a tenant, then that owner is required to include with the rental agreement a formal written notice of possible foreclosure. If the owner of the dwelling receives notice of foreclosure on the property only after a tenant has rented the dwelling, then that owner is required to notify the tenant within 5 business days (A.R.S. 33-1331). If in either situation the owner fails to provide the required notice to the tenant, then the tenant may sue the landlord in court in order to recover compensation for any damages suffered by the tenant due to the landlord’s violation of the law.
