Landlord and Tenant Rights and Responsibilities

questions & answers

Question: What are tenant rights after their home has been burglarized more than once?

Answer: If the home is a mobile home, A.R.S. title 33, chapter 11 will apply (http://www.azleg.gov/ArizonaRevisedStatutes.asp?Title=33. A tenant (of a residential house or apartment) has certain rights under A.R.S. title 33, chapter 10. Specifically, a landlord must make sure the premises are fit for a tenant to live in under A.R.S. section 33-1324 (http://azleg.gov/FormatDocument.asp?inDoc=/ars/33/01324.htm&Title=33&DocType=ARS. If a home has been burglarized and this is due to a faulty feature of the premises (I.e. broken locks), the landlord has an obligation to make sure these are fixed. Lastly, the lease signed between the tenant and the landlord may be of some help in determining specific rights and remedies.
