Question: Is it legal for the property manager to charge potential tenants an application fee then deny them from taking over the lease and then use the application fees or credit a tenants account?
Answer: As a general rule, if a property manager identifies an application fee as non-refundable, then the property manager may retain that fee and use it however they wish, even if the applicant is rejected.
