Divorce and Remarriage

questions & answers

Question: I was married to an ex marine for 10 years when I was 18. He was murdered shortly before we were divorced. Its been over 20 years but I was wondering am I still qualified for survivor's benefits or his pension?

Answer: The answer to your question depends partly on whether your husband was a career marine who served at least 20 years.  Division of pension benefits after divorce is governed by the Uniform Services Former Spouses Protection Act.  If you were married at the time of his death, you may be entitled to Survivor's Benefits, depending on the length and type of service he had.  Have you contacted the Marines about making a claim?  Here is a website that may provide some answers to your questions www.militarypay.defense.gov/Benefits/Survivor-Benefit-Program/Overview.
