QUESTIONS

  • I have a credit card with the same bank where I have a Certificate of Deposit. My credit card payments are in default. I was using a credit counseling company to help me get out of debt and help me arrange a payment plan on the overdue credit card debt. The bank used my Certificate of Deposit to pay off the credit card debt without my permission. Is this legal?
  • My car was recently repossessed. I spoke w/ the fa dept wanting to pay everything I need to pay to get it out and set my pymts up for weekly. The dept is telling me I have to wait 7-8 days for a letter to be generated and recd before I can make my pymt. Meanwhile, im getting charged storage fees everyday when I could just pay for it. Do I have to wait to receive a letter telling me I already know what happened and what I need to do? I want to pay today to get my car out.
  • Collection agency sent a letter instead of summons, is this the proper procedure?
  • Is it against the law for my creditor (car dealership)to contstanly contact me at work even after I have verbally requested them not to? What can I do to protect my employment as them constanly calling may jeopordize my employment?

  • We owe a nursing care facility 10,000 dollars. I have been sending them 20.00a month. I received a letter from them with a check for the payments I made. They are refusing my payments because they are saying the payments are too low. This is all I can afford to send. Are they legally allowed to refuse these payments? Thank You
  • I have just found out that a judgement was found against me back in 2008. It is from a credit collection company. I never recieved a notice of this Judgement and I would not have know about this jugement as it has never appeared on my credit reports. This judgement lists both myslef and my husband. I never had a credit card with my husband in this state. I would have never knoiwn about this if I was not selling my poperty. He is not listed on the deed,so can the proceeds pay for the judgement. We where never notified of the judgement under the Rules of Civil procedure # 55.
  • Do I have to pay the credit collection agency or can I choose to pay the original debtor? After all I have no contract with the collection agency.
  • Being sued by debt buyer for bank if America cc debt, served in April 2014. Did not admit to debt in my filed answer. Set for arbitration next month, does delaware sol apply? Last pmt 7/2011.
