  • We were sent to court for monies owed to an apartment compex. The judgement was against us. They were awarded the full amount, prejudgement interest, courtcosts, and attourney's fees. We made payment arrangements to prevent garnishment. now they are charging us interest on our payments but they were not awarded postjudgement interest. Are they allowed to do this? Is there anything that we can do if they shouldnt be charging us this extra money??
  • I recieved a Civil Summons at my home. I want to payoff my debt, can I just contact the plaintiff or do I need to go thru the court? Is there any other alternet course of action for me?
  • My daughter, received garnishment papers from her employer from an apartment she defaulted on. She was never notified of any garnishment by the collection agency; she was never served or summoned to court regarding the debt. Do they have to notify her before obtaining a garnishment?

I did have health insurance at the time which should have covered it. What is the statute of limitations on medical bills?
  • I have a credit card with the same bank where I have a Certificate of Deposit. My credit card payments are in default. I was using a credit counseling company to help me get out of debt and help me arrange a payment plan on the overdue credit card debt. The bank used my Certificate of Deposit to pay off the credit card debt without my permission. Is this legal?
  • I have a credit card debt from 2004 that has been sold to a collector. Can there be garnishment to wages or just go after assets. Was served papers today. There was already a judgement about a year ago. Now I go another one.
  • I purchased a farm using two different private loans(no banks). One loan was on a promissory note. Animals were used as the collateral on the note. Having defaulted on the note, I have turned over all the animals to the party owed. Is there an Arizona law or case that establishes the turnover of collateral as discharge of the note? Can you recommend a method for me to find this specific information. Thanks
  • Does a California judgment creditor HAVE to file the judgment in Arizona to garnish my wages here in AZ? The law I found ARS 12-1702 uses the phrase “may be filed in the office of the clerk of any superior court”. It doesn’t say where it says they must. If they must and have not what would be my next step in stopping the garnishment? Thank you
  • Does AZ law require the debt of a deceased relative to be paid. I am listed as a trustee on my Mothers revocable trust. Am I required to pay on any of Her debt?
