QUESTIONS

  • My tenant moved in her adult daughter with two minor children without my knowledge. When told I said she could stay as a guest for two months while she finds a place to live. This was 5 months ago. She will now not leave. I have now been told I cannot evict her because of the fair housing act although she was never on the lease and I have in no way discrimated against anyone on the lease. This makes 5 adults and 3 minors living in my 4 bedroom home. Can I evict them for breach of contract.
  • If a person has sexual contact with a minor, who lied about their age, Is there any defence? Unsure of the other parties true age (since they have lied so much). Nothing has been charged thus far, should the 'defendant' seek an attorney now. Is this a case where they could ask for PD? "D" has document mental health issues, I need to advise them on what to do asap. Will be taking "D' to mental health (emergency) clinic in the am.

  • We have sent our 5 day notification to a tenant via certified mail. The tenant is not answering the door in order to receive the mail and sign for it. We have also tried to hand deliver the letter but again no answer at the residence. What is the next step if we can not get the tenant to recieve the 5 day notice

  • My home was to be foreclosed on 6/13/14 my husband and I filed for bankruptcy on 6/11/14 and advised Ocwen, our servicer and provided the case # to them, Ocwen in turn advised us that there would be NO foreclosure that they would put a hold on it. About a week after that we received notice of the foreclosure sale date having been moved up to 7/8/2014, I again called and they advised me that there was NO sale due to the bankruptcy filed, then in next 2 weeks I had people coming to change locks on my doors which didn't happen bur was advised that my home was now REO that it had been foreclosed.
  • My ex and I had a domestic violence issue where one party assaulted the other and property was destroyed. I declined to press charges at the time (May 2018), and the charges have been dismissed without prejudice since (June 2018). Can I change my mind and still pursue charges against the other party?
